What’s going on with the case about Venezuelan immigrants deported to El Salvador by Trump over the weekend is wild, as wild as any of the very wild litigation against the Trump regime so far. 1/ #LawFedi

“Trump’s executive order is not a legitimate exercise of executive authority; it is an abuse of power in its rawest form. It reads less like a policy directive and more like a decree of vengeance.” — @mitchjackson

Lawyers for Mahmoud Khalil have filed a motion to have ICE return him to New York, asking the U.S. District Court for the Southern District of New York to protect Khalil from disruption of the underlying habeas corpus proceedings begun before ICE transferred him to Louisiana. https://s3.documentcloud.org/documents/25556767/mahmoud-khalil-motion-to-compel-return.pdf This motion shows how Trump’s treatment of Khalil is also a challenge to judicial authority. 1/ #LawFedi
Earlier this week, the U.S. Supreme Court heard oral argument in Estados Unidos Mexicano v. Smith & Wesson. Here’s my brief blog post, with an abstract and link for a forthcoming article by me that discusses the case in the broader context of a lawless high court. https://heidi-says.ghost.io/mexicos-lawsuit-against-gun-makers-and-distributors/ #LawFedi
The U.S. Supreme Court has ruled, 5-4, on the Government’s request that it vacate the trial court order requiring it to resume USAID payments of amounts owing. https://www.supremecourt.gov/opinions/24pdf/24a831_3135.pdf The SC has upheld the trial court. The opinion - majority and dissent - is notable. 1/ #LawFedi

Judges Are Fed up With Lawyers Using AI That Hallucinate Court Cases
”But if the ABA and lawyers do not speak, who will speak for the organized bar? Who will speak for the judiciary? Who will protect our system of justice? If we don’t speak now, when will we speak?
The American Bar Association has chosen to stand and speak. Now is the time for all of us to speak with one voice. We invite you to stand with us.” 12/12 #LawFedi

Judge Abelson in D.Md. just issued a nationwide preliminary injunction in NADOHE v. Trump, the case against the Anti-DEI EOs brought by the National Association of Diversity Officers of Higher Education, the American Association of University Professors, Restaurant Opportunities Center United, and the City of Baltimore. DF and AAJC represent them. Injunction applies nationwide.

the latest resignation letter in Trump’s ongoing massacre of anti-corruption prosecutors who refuse to drop charges against #EricAdams is significantly shorter than #DanielleSassoon’s letter but damn if it doesn’t get straight to the point.
> "If no lawyer within earshot of the President is willing to give him that advice, then I expect you will eventually find someone who is enough of a fool, or enough of a coward, to file your motion. But it was never going to be me."
p.s. #HaganScotten clerked for both #JohnRoberts and #BrettKavanaugh, has multiple bronze stars, and was #1 in his class at #Harvard Law.
p.p.s. the body count in this massacre is currently up to at least 7.
These resignation letters from Sassoon and Scotten are both examples of superb legal writing, and indeed, of any kind of writing.
